Please read through the following conditions. By participating in this programme, you confirm that you have read the Terms of Use and confirm your understanding thereof. These Terms of Use (the "agreement") amend company terms of all prior, applicable agreements approved between you and Dataserv Ltd. or general terms and conditions of Dataserv , should any such agreement be in existence.
1. Basic Principles of the Programme
Dataserv Ltd. operates this Trade-In programme on behalf of DELL. Under the Trade-In programme, Dataserv offers customers return acceptance of certain used computers, monitors, printers and peripheral equipment (collectively identified as "old equipment") for reasonable compensation based on the re-marketing price and the condition of the old equipment. Equipment without refundable value can be recycled free of charge through DELL. In this case, please use the existing offer from DELL under: www.dell.co.uk/recycling.
Reimbursement amounts and lists of old equipment approved for this Trade-In programme can be viewed at any time on the updated programme at
dell.trade-in-platform.com.
2. Valuation of Old Equipment
Each participant in the Trade-In programme can determine the anticipated refund value of their old equipment online at dell.trade-in-platform.com, by stating the Product Data and the Product Condition. The determination of the actual refundable value is carried out by Dataserv, following receipt of the old equipment.
3. Confirmation of the Participant and Agreement
The handling of the return and valuation of the old equipment, can take place solely online, on the Dataserv Trade-In programme website. By confirming the Terms of Use, the participant confirms that s/he is the lawful owner who is trading in the old equipment, and that this ownership is not subject to any third party, for example; title retention.
A Trade-In agreement between Dataserv and the participant is concluded through acceptance of the anticipated refundable value and confirmation of the Terms of Use.
4. Terms of Use for the Trade-In Programme
Deletion of all confidential data and information, which are in each case subject to applicable data protection legislation, and are possibly stored on the product, is the responsibility of the customer. Before shipment of the product within the framework of this Trade-In, it is incumbent upon the customer to:
- delete data from the hard drive and any other storage media in the product,
- save or transfer data of any kind and
- remove any removable storage media,for example; floppy disks, CDs or PC cards.
Dataserv accepts absolutely no responsibility for lost or confidential data and software. In the case of the conditions of this agreement not being met, Dataserv is not obligated to offer this service.
5. Return of Old Equipment
The old equipment must be packed and sent by the customer, in accordance with the instructions from Dataserv. This includes, but is not limited to, instructions on weight limitations, as well as quantity and type of equipment. The packaged old equipment must be sent with the supplied prepaid forwarding label and delivered to a post office in Germany. The customer must ensure that the material sent is only computer hardware and no other materials or products are contained. Furthermore, the customer must ensure that the products sent correspond to those recorded in the contract. The customer uses only the prepaid forwarding label sent by Dataserv. Dataserv will accept no parcels sent by customers without prepayment. In these cases, the old equipment will be deemed as not received. In the case of the conditions of this agreement not being met, Dataserv is not obligated to offer this service. Should old equipment not arrive at Dataserv within 30 days, Dataserv reserves the right to cancel the order.
6. Conditions of Refund for Those Trading Old Equipment
Refunds will be afforded to the participant by Dataserv. The payment is carried out by means of bank transfer within 30 days from receipt of old equipment by Dataserv.
Payments can only be made to a bank account in the United Kingdom.
Refunds for old equipment which are received after expiration of this period can be reduced in value to the value for old equipment in the determined condition which is officially calculated and offered on the website dell.trade-in-platform.com at the time of receipt of the old equipment.
Refund prices stated by Dataserv pertain exclusively to functioning, complete and undamaged old equipment with all accessories, an assessment by Dataserv is thereby essential upon receipt of the old equipment.
Dataserv is entitled to deduct the difference in value between stated and actual determined refundable value from any stated refundable values.
7. Returning Traded-in Old Equipment
The transfer of traded old equipment to Dataserv is binding. The participant has, however, within 14 days from confirmation of the actual refund price, the option of declining the refund and reclaiming their old equipment, provided that actual refund price emerges to be lower. Dataserv will return the old equipment within 30 working days to the participant, for a service charge of 20 EURO including V.A.T. per C.O.D. (Cash on Delivery).
Old equipment which is neither in complete or marketable condition, will be disposed of in an environmentally sound manner, provided no reclamation is made by the participant within the stated period. All brands remaining old equipment will be re-marketed by Dataserv upon expiration of the time period.
8. Ownership and Transfer of Risk
Ownership of the product passes to Dataserv upon Dataserv's receipt of the old equipment.
9. Totality and Accuracy of Data Declared
The customer is obliged to closely review all personal and in particular bank details. Agreements in which details are not complete or are false cannot be processed by Dataserv.
10. Guarantee
Dataserv guarantees that this program is conducted with appropriate diligence. Dataserv undertakes no further guarantees and rules out any guarantee, both explicit and implicit, including, but not limited to, the implicit guarantee for marketability and eligibility for a particular purpose. Your stated legal consumer rights are not affected by the restrictions stated above.
11. Limitation of Liability
Dataserv accepts no liability which goes beyond terms here listed. Dataserv rules out any liability for loss in earnings, business loss or consequential damages incidentally incurred, particularly losses and claim for damages, even if advised about such losses. Third party requirements are also excluded. You declare yourself in agreement that Dataserv is neither liable nor responsible beyond the amount which would be paid for this old equipment within the framework of the present agreement or beyond the limit amount stated in the Dataserv's general Terms and Conditions, according to which amount is lower.
12. General
No party is liable for cases resulting from failure to comply with this agreement for reasons beyond reasonable control.This agreement is non-negotiable and at any time is only valid for one customer.
